12.4 Data Loss

While we design the App to be reliable, we cannot guarantee against data loss. You are responsible for maintaining backups of your important data. We strongly recommend using the export feature regularly.

13. Limitation of Liability

13.1 Exclusion of Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, SENDEAR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

15. Account Termination and Data Deletion

15.1 Your Right to Delete

You may delete your data and stop using Sendear at any time:

  1. Delete All Data: Settings > Privacy and Data > Reset App Data
  2. Delete the App: Uninstall Sendear from your device
  3. Cancel Subscription: Through your device's app store settings (required separately)

Important: Deleting the App or your data does NOT automatically cancel any active subscription. You must cancel through your app store.

16.1 Informal Resolution

Any disputes arising from these Terms or your use of the App shall be governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

You agree to submit to the personal jurisdiction of the courts located in Ontario, Canada for any disputes not resolved informally.

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
